The lists of defaulters existing in our country are conceived as an informative tool where individuals and companies can consult if someone appears as a member of any of them because of any unpaid or outstanding debt.
From Hinojosa Abogados we talk to you today about the different lists that exist in our country and what it may imply to be part of one of them.
How to know if we are part of any of the lists of defaulters in Spain.
We speak of lists of defaulters to refer to those databases or files in which the outstanding debts or payments by those who appear in them are detailed and made known.
The purpose of this is to inform whoever wishes to consult them about the situation of persons or companies with whom it is possible that we are going to undertake some business, we have some purchase or sale pending, to know if they are solvent or have a history of non-payments that could alert us.
Be aware that sometimes we can be included in them for minor issues such as a simple unpaid cell phone fee due to discrepancies with the company, bills that we have claimed because we do not agree with the amount, traffic fines…
In Spain there are 4 lists of defaulters:
1.- CIRBE: Central of information of risks of the Bank of Spain. It is actually a file on bank credits, guarantees, loans, etc. that is elaborated so that the banking entities have a clear profile of their clients and their solvency depending not only on their assets but also on all the loans and similar that they are paying or have in course. It reflects debts of more than 9000€.
2.-RAI: Register of unpaid acceptances reflects the non-payments of which the companies are protagonists, whether they are large business groups or small businesses. Before including a company in it, a period of 90 days is given to settle the debt. If they fail to do so, they will be included in it, with the consequent obstacle that this entails for many commercial operations.
3.-ASNEF: National Association of Financial Institutions. To be in this file you must have an outstanding debt with one of the companies that make up this association, which are usually the large telecommunications and supply companies (cell phone lines, pay TV, gas, electricity, etc.).
4.-EXPERIAN BUREAU DE CRÉDITO: has a file with information of credits and outstanding debts provided by third parties, that is to say, it is the creditors who provide the data so that others can know the profile of the client with whom they may intend to carry out a financial or commercial operation.
In Hinojosa Abogados we always inform our clients that anyone can consult generally free of charge if they are immersed in any of these lists of defaulters and if so, you can only remain in them a maximum of 6 years even if the debt is not settled.
